QUESTIONS

  • My husband and I have had our grandson since last November. My daughter doesn't make time for her son. She is willing give legal guardianship of my grandson. What do we need to do ?
  • My felony conviction has been set aside. How do I now answer job app question that ask if I have "any felony convictions" or that include an exclusion of "annulled, expunged, or sealed convictions". I now know my case disposition is "set aside" (not guilty, not expunged). Based upon I read in this article, I thought I would be able to deny the felony question on job apps but none of the job apps I've seen have asked for "prior" convictions. I have been logging those questions just in case I had someone to ask on how to respond now that I have set aside order.
  • During my current 6 months of employment, I was hired as a 1099 employee and then transitioned to a W2 employee (paid salary + commission)and then forced back to a 1099 employee by my employer. Despite earning commissions from the first month of employment, I have yet to be paid any commissions. They initially told me I they would pay them and then they ignored by requests for payment. Can an employer withhold and deny paying earned commissions and if so, how long. Are they subject to any penalties or fines for will fully with holding earned commission? What can I do?

She had assets under $10,000 and no real property. I found the small estate affidavit. There are three surviving children, 1 deceased with 2 children. I assume we all need to fill out an affidavit? One of the grandchildren is still a minor. Who fills out his?

  • My daughter has two children with her ex-boyfriend that she has lived with since 2010. He is refusing to pay child support. His name is not on the birth certificates. What is the next step? Do we need to file a petition with the court or contact DES first? I'm assuming he will have to take a paternity test. Thank you.
  • If an adult child is living with his father and the father decides to kick the child out of the house. Does it require eviction notice before requiring them to leave? If possessions of the child are still in the house, how does the child go about retrieving them?
  • I was born in CA and started using my step-father's last name at approx. 8 years old. I never legally changed my last name but my military records, ssn, etc. all use my step-father's last name which I've used throughout my life. I'm now a resident of AZ. Can I legally change my name here to the name I'm already using for all forms of ID/records? I just want to ensure my birth cert matches all my other forms of ID. Thanks
