  • I have a 10 year old daughter that I have sole custody of- I never married her biological dad. I have since married and wanted to know if that would then make him a legal guardian of my daughter?
  • My teenage daughter and I were both arrest for domestic violence and both of us were prosecuted. Same case yet we were both identified as defendants which very effectively eliminated any accountability especially by the courts to address "Victim's Rights" at all. The words "dominate aggressor" does not exist , at least not in the statues in AZ. So my question is: How do the courts justify this? Is this ethical? Every justification so far has been absolutely absurd. Have you thought this through at all? Obviously: no victim, double fees, more income, more DV programs as Dual arrests increase
  • Is it legal for my lender to switch lenders and foreclose my house and sell at auction with out giving me any notification or giving me the option to file bankruptcy
  • I filed for ch. 7 bankruptcy and my debts were discharged on June 2011. To this date I'm badly behind on my house payments, and my lender offers me a reduced monthly payment of $350. The problem is that my lender does not want to make any promises in writing and does not give me straight answers on what happens if I keep my end of the deal. I'm affraid my lender will simply foreclose when it may fit its interest, disregard of my needs. Also, it is wise to enter into any deals post bankruptcy if my debts are discharded already and thus, uncollectable? Thanks!
  • My wife and I were sued for unsecured debt. We have two minor children that both have a bank account with my wife on each. The creditor seized thier accounts. My daughter has a babysitting job she does, and my son's account was set up to recieve his student financial aid. Luckily, he had already purchased books and payed for his summer classes. I have heard that Federal student aid was exempt from this. What can we do to stop this and can we get our sons school money back?

  • What is the Arizona statute of limitations for a car loan on a repossessed car? 4 years or 6 years? When does it start running? After the first missed payment, or after the car gets auctioned off? Some people say the S.O.L. is 4 years because it is a car loan, and falls under this law: "47-2725. Statute of limitations in contracts for sale A. An action for breach of any contract for sale must be commenced within four years after the cause of action has accrued." Others say it is a written contract and therefore is subject to the standard 6 year S.O.L. Which one is correct?

  • My ex-wife and I are going through a divorce and currently we have temp orders for our children. We currently have 50/50 shared joint legal decision making. The orders state supervision around her sister at all time. This is because of a drug issue. I initially filed for 50/50 and no visitations with her sister. My wife asked for sole custody. I feel it is in the best interest of the children to not be around her sister due to the drug problem. How will a judge look at this because her sister is not the one I am divorcing, but she is already in the temp orders and the kids are around her?
