My apartment lease will be expiring in a few months and the new lease that has been proposed includes a new payment for a percentage of the common area utilities. The calculation is based on the total utility bill for the common areas then breaks down by square footage and number of occupants of each apartment. The monthly charges will fluctuate from month to moth as the common area charges change. My questions are is this legal? Aren't we already paying for the common area utilities by paying rent? Would this not be consider a double dip? Please advise. Thank you, Kathleen Ingram

My fuance is in jail facing prison time he has a son whom he left in my care in his home on the reservation his aunt filed for custody of my stepson and won citing that i was not a tribal member and therefore did not qualify as a suitable gaurdian. My stepson is not a registered tribal member and i will be marrying his father soon.my son currently lives off rez with his aunt now are there jurisdiction issues? Can i petiin the court in his aunts area to be heard? Do i have any kind of legal legs to stand on?i want my son i am not struggling with addiction or have a criminal record

Does a California judgment creditor HAVE to file the judgment in Arizona to garnish my wages here in AZ? The law I found ARS 12-1702 uses the phrase “may be filed in the office of the clerk of any superior court”. It doesn’t say where it says they must. If they must and have not what would be my next step in stopping the garnishment? Thank you

I am a landlord for a home in Queen Creek. I've been notified by 2 neighbors that the tenants in my home have 5+ dogs that are a barking nuisance and are conducting a breeding business. The rental contract only discloses 3 dogs and no breeding was ever mentioned. I want to know what my liability is as a landlord if the dogs get out and bite a neighbor. Am I required to maintain a tight fenced yard? Is the continual barking nuisance my concern or should I tell neighbors to call animal control?

Can my current employer require me to sign a certification which prohibits me from holding and using my real estate license or appraiser's license. I was hired in the Real Estate Owned dept of a bank and this was not a requirement as a condition of employment originally but now they want this certification signed, can they terminate my employment if I refuse to sign the certification?

My mother had quad bypass surgery 10/07. Upon coming home from the hospital we needed a caregiver to help my mom take her meds go to the bathroom , feed herself , bathe herself etc. After 90 days my mothers LTC kicked in. We filed a claim with Humana , which is the provider that administers her medicare , on 04/20/07. We called a couple of weeks later and were told it takes 30 days to process. We then called the end of May and were told they have it but to wait another 30 days. We called at the end of June and were now told it was in the wrong dept but it would now be expedited. I called mid July spoke to a "manager " Joe Clark who said it was still in the worng dept but he wopuld expedite it and call me back in 1-2 days. NO CALL 10 days later I call and speak to Stephanie, and she tells me her sup. will call me back NO CALL. i call 5 days later speak to Woodley , he tells me he has no idea about the delay but will rush it. I call at the end of July speak to yet another manager who tells me they "changed" vendors and need me to refax the entire claim. She asks me what the claim is about I tell her and she tells me that what I described to her is really more "housekeeping" work and not covered. KEEP IN MIND she hasn't even reviewed the claim. I am now approaching 4 months since we first submitted this and I am at wits end. What are my options to get this expedited one way or another
