  • We are owners of a double wide in a moblie home park in Tucson.  We live out of state and for the last 5 months have received only partial payments and at this time a tenant is 4 months past due in agreed payments. We have had several issues with this problem, and feel we can no longer allow this person to occupy our property and would like to have someone tell us how we can go about serving notice for an eviction. We have read the laws of Arizona and know that a paper has to be obtained, filed, and paid for by us and then sent on to the occupant of property.  How can we start this procedure?
  • If a parent is in the military and their legal state of residence is Arizona, and so was the spouses and children at time of filing, wouldn't that give Arizona jurisdiction for child custody? Even if neither person had lived in Arizona for the past 11 yrs? Parent filing at the time was stationed overseas, but has since moved back to the states. The other parent (who has the children) resides in Kentucky, but at the time was not a legal resident of Kentucky.

  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?

We moved into my 1800 sq.ft. home with 3 bedrooms as it is affordable for us without straining and comfortable as we see it.
