QUESTIONS

  • I acquired a credit card in 2001 and never made a payment on the debt. A judgment was filed in Ohio. I moved to AZ and the collector filed a foreign judgment Jan 31, 2008 and filed an Affidavit for Renewal February 26, 2013. from what I have read, the statute of limitations is 5 years, since they recorded the renewal 1 month after the expiration, is this debt enforceable?
  • My roommate flaked out on me and I need to pay a termination fee for the apartment. We are both signed on the lease but I need to know if my roommate is also responsible to split the termination fee and if so, what if my roommate refuses? Will she be responsible for paying her part? The termination fee is four months of rent and I am able to pay two (half) of the overall fee. My landlords said if she won't pay her part, it will be sent to collections and they will also require me to pay the remaining balance if she doesn't.
  • Am I required to provide fire extinguishers for tenants?
  • I agreed to purchase a home I believed was owned free and clear by the owner with owner financing. I later learned the owner did not own the home free and clear, and when costly repairs come up he refused to help defray the costs. Was I protected under the tenant landlord act and can he foreclose as he is threatening? I have already moved out and found a new place to live.
  • Due to domestic violence/ child support I have received permanent guardianship of my 16 year old niece. Her Mother is still paying child support to the Father in another county. How do I get that paid to me and also get a child support order in place for the Father? Is there any SSI or govt assistance I can get help from?
  • My ex husband recently passed away and his only children were named sole beneficiaries in the divorce decree(irrevocable).The decree states that he was to maintain a policy through his employer but his widow insists he only had one policy that she purchased and maintained through AFLACK. How can my children find out if they are entitled to any monies from this or any other policy that could be hidden. His widow insists that she has nothing and that he had no will
  • I have a 1 year lease to rent a house, in that lease was added that have the option to extend for 1 year with a 5% increase in rent. I tried to exercise my option at the end of the lease per the agremment but the landlord say he does not want to. They are offering to pay me to get out and I said that would be fine so I calculated my expense to make the move to other comparable accommodations. He refuse to pay the amount and says to to get out or we will go to litagation, . I feel he is in breach of contract. Id rather stay than collect what I feel is my costs to make the move.
  • The house we are leasing has a converted garage that we were told is used as an office for the LL and he occasionally stays overnight when necessary. Although there is no mention of sharing the property in the lease, there is a small statement that the LL will pay $60 toward monthly rent for electricity. Isnt he liable for a share of all the utilities?Also, much if his behavior feels intrusive. What rights do we have re: Quiet Enjoyment?
  • I was recently let go from my job of 5 yrs. for testing positive on a random drug n alcohol test. I dont drink and the test showed the levels of scoop mouthwash alcohol content not what was in my body. I told my manger but he let me go anyway. How can I show that it was a false reading? I am allergic to alcohol.
  • My step-son was arrested by Phoenix PD on 2 counts of agg. assalt w/deadly weapon. He was protecting his mother from a drunk neighbor who was about to beat his mother up at their front door. He had picked up his rifle and had it in his left hand when he open ed the door to get his mother inside their apartment and away from the drunk. My question is why was he even charged? As an ex-law enforcement officer I would see this a self-defense. The state is now wanting to give him up 25yrs per count. Is there any case histories that a ruling would apply this case to self-defense.
