QUESTIONS

  • Landlord was notified about roach problem. Landlord hired pest control services. Three months later, previous pest control services had no effect. Tenant notified landlord. Tennant hired own pest control services. Pest problem going down. Today, water heater caught fire and now needs replaced. Cause of fire is most likely the roaches. Can Tennant break lease legally and without reprocussions or have rental payment returned?
  • Our original divorce decree did not stipulate payment for secondary education. Can this be modified now that the children are 18 and in college. Child Support payments are still being made.
  • My sister died in April leaving her estate to 2 foster children. Her personal representative quit in May and no one has assumed control of the estate and he has not turned it over to anyone. I fear the home will go into foreclosure. I would like to have a private fiduciary take over, what do I have to do to make that happen? The foster children are listed as her only heirs, my brothers are furious, can they prevent a private fiduciary from assuming control and force the foreclosure and loss of her estate? I don't have funds to hire a lawyer, how can I get this accomplished?
  • We fell on hard times and couldn't pay our car payment for a leased vehicle. They repossessed the car, sold it and now are suing us for almost the full price that it was being sold for. are we responsible for the full price of a leased vehicle. Why wouldn't we be responsible for just the remainder of the lease payments? And why should we have to pay them for a vehicle we don't have anymore. We can barely make ends meet now a garnishment would make us homeless.
  • My husband and I have been married for 19 years. Common Law for 4 years and 14 years Legally Married (State of NM). We have been separated for 3 months, if I decided to divorce my husband my reason is "Adultery". We have a State Marriage Licence and we married in Navajo Nation Court. Do I file with the State of New Mexico or Navajo Nation. We have 2 children therefore child support will be filed. And can I charge my husband and his companion with "Adultery"?
  • In AZ can the courts take up to 50% of the income for monthly child support? I have one daughter from a previous relationship who receives child support and my ex that is the mother of my two sons that is filing for child support. How would it be calculated among the children?
  • My son is 22years old and is Developmentally Disabled. Is there a free or low cost service that can help with obtaining guardianship to protect his interests? He is agreeable to the guardianship (I am his mother), but our financial situation does not provide additional means to retain a lawyer to pursue filing for guardianship.
  • A few days before I turned 18, my adopted family of 4 years kicked me out and dropped me off at my birth mothers house. (Who is not capable of taking care of me) they didn't even give me a quarter of my belongings and I also didn't receive any of my documents (I.e birth certificate, social security card, etc) this has caused me many problems in the year since dealing with trying to get a car, registering for college and other things. In order to get new documents, I need to have other documents and I have none. Is there something I can legally do?
  • A cop came to my place of work and told me if I contact my ex he would throw me in jail. I've not had any orders by the court so can he it?
  • My son was placed in guardianship approximately 5 yrs ago. recently he (16) has expressed desire to return to living with me as he no longer feels safe or wanted at grandmas who has guardianship. He has threatened to run away many times. Frequently asks me to get him away from there as he is told almost daily that he needs them, they don't need him or that he will be sent to fostercare if he keeps on going way he is. Also that he will never be able to return to live with me again. (my rights were not terminated). What do I need to do to end the guardianship so he can come back to live with me?
