Question: I have a dughter who i want custody of, her grandmother says she has custody. Grandmother says that her daughter, amanda gave up her rights to our daughter. I was in prison while this was going on and they told judge they didnt know where i was. anyway, her environment is very bad for her. I have a fiance of 3 years and decided i dont care if my daughter hates me and doesnt want to live with me i cant continue to let her live like she is. it is not good for her well being. how do i get a hold of documents to find out who has custody and if mom gave up all rights? mom is in jail now.
Answer:
-Generally, by visiting the local court they can help a parent look up any case information related to a father/mother, see this link here for a map of courts in Arizona and click on the correct County for that specific court; from there, it may be possible to identify who has custody of the child. Arizona Revised Statute 25-403 tells how custody is determined. If, in fact, custody is determined to be with someone else, the parent of the child can file with the court to modify custody, see this link for the self-help section of the Superior Court’s website. Lastly, it may be in a parents best interest to talk with an attorney because of the sensitive nature of custody proceedings.
