Question: I filed for a temporary order for parenting time and sent the papers to the last known address, and the papers were returned to me. What happens if i don't get them delivered because I have no clue where he lives at, with my children? Does my childrens father have the right to keep his address from me when there's no custody order and I also have a order of protection against him

Answer: You may wish to contact the clerk at your local courthouse and describe the situation. The court may have the address or at least further specific suggestions. With regard to the service of papers, whenever someone in Arizona is unable to serve court papers on another person in the usual ways because that person’s address is not known to them, they do have the option of “service by publication” (in which notice is placed in the newspaper). However, before service by publication will be permitted, the petitioner must make “reasonable efforts” to try to find the respondent’s address: by asking friends, relatives, coworkers, etc.;by searching online and through social networking sites; by contacting the Dept. of Corrections; and so on.
