Question: What were to happen if I filed for child support while the other parent is in prison?

Answer: The answer to your question depends on a number of factors. If your ex has income or assets that provide an income while he or she is in prison, the court may use that property to order support.  Ordinarily, the court will assume an income for the unemployed or underemployed, non-custodial parent.  However, the 2018 Arizona Child Support Guidelines, which go into effect on April 1, 2018, clearly state that the court may not assume an income for a person who is incarcerated.
