Question: My wife and I separated not under the best terms. she has lost her job her car and is about to lose her apt. the place she might move to has three grown men living there. My daughter is five and she needs her own space to be a kid all threemen are felons. One of them just got off of 25 year probation as a sex offender. being a minor . my wife knows about this..i cant have my daughter living there. isn't that neglect. who would want their child in any type of possible sexual crime
Answer: You do not mention whether your separation is a legal separation with a court order dividing property and establishing custody and child support. If that is the case, you will want to go back to court to modify the orders as allowed by Arizona Revised Statutes, Section 25-411. If there is no formal order, you have the right to file for a divorce or legal separation and seek custody of your daughter. You would be best served by sitting down and discussing the details of your situation with an attorney. There are three programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. You will need to apply for the program and meet the financial need qualifications. Once qualified, Modest Means will send you a list of attorneys to choose from. Then, for a $75 fee, you will receive a one hour consultation with the attorney. If you need additional help and the attorney agrees to take your case, the fee charged will not be more than $75 per hour. The telephone number is (866) 637-5341. Both Maricopa and Pima County Bar Associations have Lawyer Referral programs that offer a 30 minute consult with an attorney.
