Child Custody

questions & answers

Question: I have to take my kids on zoo in sc doing the I have the kids. Do I have tell their mom or get her perision? We have 50/ 50

Answer: I am not certain what you are asking when you refer to "on zoo."  I know it must be a typo, but it confuses your question.  Arizona Revised Statutes, Section 25-408 requires that a parent with 50/50 custody notify the other parent 45 days before relocating the child more than 100 miles. If your plan is to move to South Carolina with the kids, you must give her legal notice (45 days) so that she can file an objection in the court.  Moving and relocating your children without such notice can cost you your custody rights.   If your plan is to take the kids on a vacation to South Carolina during your parenting time and return them when mom's parenting time is scheduled to resume, then, you should be free to do so, but you must still notify the mom of your plans. Taking the children out of state without informing her can only worsen any conflicts between you.  Will the mom agree to a short visit to South Carolina if you pay the costs?  If not, perhaps, you and mom can agree to switch your time with the kids, so you can take the trip.
