Question: my 2 year old son has his fathers surname we are not married but he wanted this to be,i was wondering if i leave my boyfriend will he be able to take my son away just because the child holds the same surname as him and not my surname?
Answer:
The child's last name really is not a factor in the situation. Both you as the child's mother, and your boyfriend, as the child's father, have certain parental rights. Should you and your boyfriend split, there is a possibility that your boyfriend may file paperwork to establish custody and parenting time orders through the court.
