Visitation

questions & answers

Question: I have temp custody of my grandson, his mother has supervised visitation. I offered to supervise these visits based on the discussion in court. Take him to chucky cheese or something to play and he is visiting with mom. SToday is our first visit and I while she will not anwser me regarding her plans. I know she is planning to have her boyfriend and a number of others to her home where she has requested to visit with her son. I am not at all comfortable with this situation but am not sure what I can do.

Answer: The custody and visitation orders will be the primary source of information that will help determine what is allowed during visitation and how to resolve legal disputes. It is best to look at this order to determine what legal rights are available. The law allows for a hearing over parenting time to be filed with the court so that a judge may decide and settle the dispute based upon the facts of the dispute (http://www.azleg.gov/FormatDocument.asp?inDoc=/ars/25/00328.htm&Title=25&DocType=ARS). It is important to give relevant facts about concerns and issues that could be a danger to the child in any way. Ultimately the judge will decide based upon what they find is in the best interest of the child. If there is a fear that the child is in danger then it is best to contact the local authorities or Child Protective Services (CPS) (https://www.azdes.gov/dcyf/cps/reporting.asp) at 1-888-SOS-CHILD (1-888-767-2445).
