Question: My husband is having a adultery, can I report him and her to the police? Would they both prosecuted? She is also marriage in China.
Answer: Adultery is a crime under Arizona law. Arizona Revised Statutes, Section 13-1408 defines adultery as a married person having sex with an adult who is not the spouse or an unmarried person having sex with a married person. In order to prosecute, the law requires you to file an adultery complaint with the police. The offense is a class 3 misdemeanor punishable by a $500.00 fine and up to one year of probation.
