Question: My daughters dad just passed away and me and him both have custody of my daughter . My daughter is with his mom right now but I want her with me . How can i go get her without running into any problems ?

Answer: I am assuming from the way your question is worded that you have joint custody (joint legal-decision making).  His death leaves you in the position of being sole custodial parent.  You have not said why the child is with her paternal grandmother.  If you have a court order giving you joint legal decision-making (custody), there should be no legal way grandma can object to you taking custody of the child.  A certified copy of your court order for custody should be sufficient evidence of your right to take the child with you.
