Question: How can I be eligible for the first offenders program? Since this is my first offense. I have recently been charged with a class 6 felony. I have been appointed a lawyer, but have had no success conversing with him. I'm not sure how my case is going to go or what i need to provide for it. (Its for a small possesion of marijuana)
Answer: Diversion and deferred sentencing programs are at the discretion of the County Attorney where charges are filed. Arizona Revised Statute 11-361 gives you the restrictions to diversion/deferred sentencing. Certain scenarios are not eligible for these programs. From what information you have provided, you may be eligible. Again, it will be at the discretion of the County Attorney.
