Generally you can only sue the employer under two scenarios – first, if you opted out of workers’ compensation coverage, and second if the employer is uninsured and you choose to pursue the claim as a personal injury, rather than through the comp system. Barring those two scenarios, the employer is generally protected from suit in regards to the workers compensation injury.
