Question: Is having a working phone line (I ordered phone service but there are no phone jacks in my house) considered an essential utility?
Answer:
A landlord is required to provide running water, hot water, reasonable heat and reasonable air conditioning or cooling (A.R.S. 33-1324 A (6)). If the lease agreement contains a provision about phone lines, the lease may give the tenant more rights. A lease is a contract and all provisions are binding so long as they are legal within the context of A.R.S. § 33-1342. In other words, the landlord can only contract certain things (one of them being added utilities). (A.R.S. 33-1413.03)
