Question: After a 24 hour eviction can you receive your rent or deposit back?
Answer: There are circumstances under which a landlord is not required to return a security deposit (A.R.S. 33-1321). A landlord may use funds from a security deposit to cover unpaid rent or money due as the result of damages. If there are leftover funds in a refundable deposit, then the landlord must return the remaining amount to the tenant. However, not all deposits are refundable security deposits and there are circumstances which may justify the landlord in withholding the deposit. To determine whether a deposit should be returned, consult an attorney for advice about a specific the situation or lease.
