QUESTIONS

  • I have a question regarding The Uniform Services Former Spouses Protection Act. I retired from the military in 2010 and married my current spouse in 2012. We were not married nor had any relationship while I was on active duty. My question is, if my spouse and I are divorced is she protected under The Uniform Services Former Spouses Protection Act? Basically is she entitled to any portion of my retirement pay in case of a divorce?
  • I left an abusive marriage in another state 16 years ago. My husband has died. This was a second marriage so I want to go back to the name prior to this marriage since I have adult children with that name and plan to be buried with the first husband. What will I need to proceed with this name change.

  • My parents are on social security income only and we are evaluating whether to put my Dad in a nursing home. He would most likely be eligible for ALTCS. My parents own their home and it is the only asset left to support my mother. I heard that a nursing home can take half the house value if the house is sold within 3 years of my father entering a facility. Can the home be put into a trust for my mother or sold to a family member before my father enters a nursing home to avoid this?
  • If when signing the plea the judge states "I will allow the felony to be set aside." After completing probation I was denied. The felony is Agg. Assault and I know that violent crimes are not eligible to be set aside. But I feel there should be accountability. What are the options?
  • I am the gaurdian of my disabled son. He recieves social security because I am disabled. The guardianship began on his 18th birthday. Because I am traveling I have an agreement with his mother for him to stay with her. She expects me to continue to send her an additional $1200 because that was my child support agreement. I told her that was changing. She needed to provide reciepts for reimbursement for any thing above his room and board. She believes this money is for her use and has filed a motion to have herself named as guardian. Question does child support continue for an adult in guardian
