Question: Can a Property Manager represent the owner in the JP Courts or is an attorney required?
Answer:
The answer will depend on what kind of claim is being brought before the justice court. If the case is in small claims division of the justice court, the party to the action must represent itself. A.R.S. 22-512. However, as to a partnership, corporation, or association, an "authorized, full-time employee" may bring the action on behalf of his employer. A.R.S. 22-512(B). Unless stipulated in writing prior to the hearing attorneys are not allowed to participate a small claims court action.
If the case is another division of the Justice court, the rules regarding the practice of law will apply and the party must either represent itself or have an attorney. Without more information, it is impossible to determine whether a property manager could represent the owner in another division of the Justice court. To determine whether this would be allowable, consult a licensed attorney.
