questions & answers
Question: I emailed my landlord and gave him a 30 day notice and he emailed back and accepted it. Now he says I have to pay another month rent and send a certified letter stating when I am going to leave. I have all the corresponding email even the one where he is trying to intimidate me. my husband retired from the marines and had to leave for another job in WA State and we had to stay behind because he is making us pay another month or longer. Is this legal
Answer: If you have a month-to month rental the "30 day notice" must be received at 30 days prior to the rental due date (ARS-33-1375 B). Although written notice via certified mail is a good idea if the landlord had "actual notice" that should be sufficient (ARS 33-1313 A. If you have an e-mail from the landlord acknowledging and accepting your notice that should be enough.
