Question: If there is a broken sprinkler valve, are we, the tenant, responsible for fixing this or the landlord? I have requested the landlord to fix it but they are saying it is our responsibility. It was given to us in working condition but it has broken. We have lived here for almost 2 years now. Thank you!
Answer: According to the Arizona Tenant's Rights and Responsibilities Handbook put out by the Arizona Attorney General's Office:
II. Maintaining the Home
A. You must obey all health and safety provisions of the building codes.
B. You must keep the home clean and safe.
C. You must dispose of trash in a clean and safe manner.
D. You must keep all plumbing clean.
E. You must use the facilities in a reasonable manner, including electrical, heating,
air conditioning, plumbing, appliances, and elevators.
F. You must notify the landlord if a repair needs to be made. (See “Failure to
Maintain Home” on page 14.)
G. You must not negligently or deliberately damage any part of the property or let
any guest cause damage or you will be held responsible for those damages.
H. You must not disturb your neighbors’ peaceful enjoyment of the premises.
ARS 33-321. Maintenance of premises
A tenant shall exercise diligence to maintain the premises in as good condition as when he took possession, ordinary wear and tear excepted.
