Question: My mom has asked my neice to move out. She wont pay rent or move out. What can my mom do to make her move out?
Answer: This depends on whether she is considered a tenant or a guest. If there was an understanding that she was going to be renting a room then the landlord/tenant act would apply. If she is just a guest the act would not apply. If she is a tenant you must first give a written notice that if all backdue rent is not paid within 5 days her tenancy will terminate. If she does not pay you then need to file a FED (forcible entry and detainer action) in Justice of the Peace Court and seek a formal order of eviction. If she is only a guest and refuses to leave you could change the locks or consider the matter a criminal trespass and call the police.
