Question: My mother is renting a home and wants to increase the term of her lease, but she is wondering if she can terminate the lease early if she has a medical situation that requires her to move? Does she need to include a clause in the lease to cover that situation?
Answer: A medical condition does not automatically give a residential tenant the right to terminate a lease without penalty, so it would be wise for a tenant who is concerned that she may need to move during the middle of the term of a new rental agreement to request that the landlord agree to the inclusion of a written provision in the lease that discusses that possibly and identifies what the tenant’s and landlord’s rights and responsibilities will be should it happen.
