Question: When living in an apartment/ student living apartment complex in college, is the landlord allowed to only allow one person per room? What if someone is married and wants to live there? Or any significant other for that matter

Answer: As a general rule, a private residential landlord may through a rental agreement limit the number of persons who live in a rented room or dwelling so long as they apply that rule evenly and do not discriminate against particular individuals on the basis of some protected class – such as by permitting married couples to cohabitate but not permitting unmarried couples to cohabitate. Such discrimination is prohibited by the Fair Housing Act.
