Question: I rent a house and the contract will expired on 01/31/2020. On 01/03/2020 I gave the tenants a notice to NOT renew the lease agreement and advised them to have the property vacated by 02/05/2020. The tenants now said they don't wanna moved out because they have been paying the rent and I will caused them changes and stress to their kids... what should I do? I need to sell that house. Am I doing this wrong? Any help would be greatly appreciated.
Answer: Under the Arizona Residential Landlord and Tenant Act, a landlord may terminate a rental agreement with 30 days’ written notice before the agreement is set to expire (A.R.S. 33-1375). The landlord should keep a copy of the notice for their records. The notice must be served on the tenant at least 30 days before the end of the next rental period – which means that if rent is paid on the first of each month, then the end of the 30-day period must fall at the end of the following month. So, for example, if a landlord gives a tenant written notice on January 3, then the rental agreement will end on February 28th (or 29th) (the end of the following month).
