Question: We are landlords. Our tenants reported an outside water leak to us which we had completely fixed within 4 hours of being reported to us. Tenants are asking if we are responsible for any of their high water bill. Bill is 2-3x regular amount. In lease, it is specified that tenant pays all utilities.
Answer: Under the Arizona Residential Landlord and Tenant Act, the maintenance of plumbing is the landlord’s responsibility (A.R.S. 33-1324). However, the Act does not directly address the issue of who should pay what in the sort of situation you describe. It does, however, require all parties to act in “good faith” (A.R.S. 33-1311), which is often understood to mean that the landlord and the tenant should work out an arrangement that is fair to both parties under the circumstances.
