Question: I found out tenants are running a daycare on my property that I was not aware of and is not authorized. What are my rights? I was notified by a real estate agent.
Answer: Section A.R.S. § 33-1344 of the Arizona Residential Landlord and Tenant Act (ARLTA) says the following: “Unless otherwise agreed, the tenant shall occupy his dwelling unit only as a dwelling unit.” If a tenant is violating a rental agreement (which incorporates the ARLTA), a landlord may notify the tenant in writing that if the tenant does not fix the violation within 10 days after receiving the written notice, the landlord may take the tenant to court to seek the tenant’s eviction (A.R.S. § 33-1368(A)).
