Question: I purchased a home about a year ago with my domestic partner. I am the only person financially responsible for the home. I added my domestic partners name to the title as a joint ownership. In case in the future my domestic partner and I part ways, would we have to sell the home? Does she have any legal rights over the home?
Answer:
If a person's name has been added to the title then that person has an ownership interest in the property. That the person is not responsible for the mortgage will be of little import. If the relationship ends, the parties don't necessarily have to sell the property, but they may have to come to a settlement depending on the situation.
To find out how the law applies to your specific situation, you may want to contact a real estate/real property attorney.
