Question: I have just been approved for an appartment in Peoria and I had to pay $125 admin. fee. This fee was supposed to be part of other fees during move in and now they are saying that it isn't. What can I do?
Answer:
The Arizona Residential Landlord and Tenant Act has little to say regarding fees. The law does limit the amount a landlord can require as a security deposit and mandates disclosure fo the purpose of any nonrefundable fees or deposits. A.R.S. 33-1321. The Act permits the parties to the lease to establish most terms as they so choose. A.R.S. 33-1214. It is impossible to properly answer this question without more facts. To determine if an agreement has been breached or any rights have been violated, consult a licensed attorney.
