Question: Is it legal for my landlord to charge me to have her call a repairman out for health and safety related repairs? The heater stopped working and it is below freezing at night and she says she will call someone out after we pay her $75 to make the call.
Answer: NO! The landlord/tenant act requires that a landlord "reasonable heat' (ARS 33-1324 (6). If he fails to do so you first must provide 'reasonable notice' of the problem (should be in writing) and if the problem is not corrected you can terminate the rental agreement or recover damages based upon the diminution of the rental value (ARS 33-1364 A).
