Question: I'm a landlord, I was given $500 security deposit. I even allowed them to unload their moving truck 2 days prior to signing the lease. The night we were due to sign the lease they backed out. Do I need to give their deposit back? They used my home as a storage facility and now my home has an overwhelming cigarette smoke due to their belongings!
Answer: According to A.R.S. 33-1321 the security deposit may be applied to the payment damages that the landlord has suffered by reason of the tenants. The landlord must provide an itemize list of the deductions made due to damages and have written notice delivered to the tenant within fourteen days of the termination. Since you never had a signed lease, I suggest you contact an attorney for advice since you seem to have a special circumstance.
