Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I moved into an apartment and signed a one year lease, which is up in October. I signed up for Direct TV and they installed a satellite dish. Other tenants have dishes, as well. The complex changed property mgmt companies in June and they told us we had to discontinue our service and remove the dishes, as they were painting the outside of the buildings. They also told us we could not reinstall the dishes. I haven't had TV service since July 1. Can I legally break my lease without cost to me?

Answer: A landlord cannot change the terms of the agreement during the term of the lease. If the satellite dish was permitted when you move in that should be true for the course of the lease. I don't think, however, that this breach is sufficnet to allow you to 'break the lease' without penalty.
