Question: For the past 4 months my landlord has put the wrong name on my rent statement. All paid on time and signed by them but my name on the agreement is wrong by their doing. Could this effect me? What if I'm not getting the credit for all my paid on time rent?

Answer: If a landlord were to take a tenant to court in an attempt to evict the tenant for nonpayment of rent (under A.R.S. 33-1368(B)), then both the landlord and the tenant would have an opportunity to testify under oath in front of the judge about whether or not the rent was paid. A tenant is always advised to obtain signed receipts showing that their rent was paid in full and on time with cash or to pay their rent by check or direct deposit in order to be able to support their testimony with additional documentary evidence. Although a tenant should insist that all documentation from their landlord contain the tenant’s correct name and address, proof of payment is what matters most.
