Question: We've been living in a rental home for 4 years and the last few months went to a month to month lease. We've never been late with rent but we received a 30 day notice to vacate. We were told by the property management company that the owners are in trouble. I am disabled and this is causing me to have flare ups in my conditions. We've asked for an extension but was told no. Do we have any other options to get more time?
Answer: Unfortunately, a month-to-month rental agreement may be terminated without reason by either party with 30 days’ notice (A.R.S. 33-1375). Your best bet may be to try to negotiate an extension. As a general rule (unless a written rental agreement says otherwise), the 30 days’ notice goes into effect at the start of the next rental period: so a 30-day notice provided on August 15th means that the rental agreement will end on September 30th just as a 30-day notice provided on August 31st means that the rental agreement will end on September 30th. (The tenant gets one full rental period’s notice in order to find a new place to live, and the landlord gets one full rental period’s notice in order to find a new tenant.)
