Question: I Sublet a room in the house I live in and the Roommate stopped paying rent. December 1st will be 3 months not paid. There is NO lease. The agreement was pay weekly and utilities included.

Answer: Under Arizona law, a rental agreement is any agreement – whether written or verbal – reflecting the terms and conditions concerning the use and occupancy of a dwelling (A.R.S. 33-1310). When the rental agreement is a month-to-month agreement, the landlord or the tenant may terminate the agreement by providing the other with 10’ days written notice (A.R.S. 33-1375). If a tenant is failing to pay the agreed-upon rent, the landlord may serve the tenant with a 5-day written notice of nonpayment of rent informing the tenant that if the tenant does not either vacate the dwelling (move out) or pay the amount that they owe as the landlord has specified in the notice within 5 days after receiving the notice, then the landlord will go to court to seek their eviction (A.R.S. 33-1368(B)).
