Question: Hi what are my rights in regards to living in a motel ? We have been here for over 2 months , now we don't have enough to pay we need some time , how long do we have before they can kick us out . urgent mess please respond

Answer: Under the Arizona Residential Landlord and Tenant Act, a landlord must provide a tenant with at least five days written notice before they may take the tenant to court to have them evicted for nonpayment of rent (A.R.S. 33-1368(A)). Some tenants who reside in motels under the terms of a residential rental agreement may be protected by this five-day provision, but most will not be, because the provision does not apply to regular (even long-term) “guests.” This is because the Act does not cover “transient occupancy in a hotel, motel or recreational lodging” (A.R.S. 33-1308).
