Question: Who will be responsible for the lot rent if someone sells a mobile home to someone else but they are not accepted in the park?
Answer: The answer to the question will depend (1), from a landlord-tenant law point of view, on whether the seller still has a valid and ongoing rental agreement with the mobile home park landlord for the mobile home space even after the buyer purchases the mobile home; and (2), from a contract law point of view, on exactly what the specific agreement between the seller and the buyer is. Both the seller and the buyer would be wise to ensure – before the sale is finalized – that the seller’s tenancy relationship with the landlord will terminate and that buyer will able to move into the space.
