Question: My plumbing is messed up and it is because of the underneath plumbing of my mobile home they have to put in new plumbing pipes to make the flow of water go down better am I responsible for that or is the mobile home Park responsible
Answer: Under Section 33-1434 of the Arizona Mobile Home Parks Residential Landlord and Tenant Act, the landlord is required (among other things) to: 1. Comply with the requirements of all applicable city, county and state codes materially affecting health and safety. 2. Make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition. 6. Furnish outlets for electric, water and sewer services. Under Section 33-1451 of the Act, the tenant is required (among other things) to: 1. Comply with all obligations primarily imposed on tenants by applicable provisions of city, county and state codes materially affecting health and safety. 2. Keep that part of the premises that the tenant occupies and uses as clean and safe as the condition of the premises permits. 4. Not deliberately or negligently destroy, deface, damage, impair or remove any part of the premises or knowingly permit any person to do so. A tenant who believes that the landlord should be responsible for fixing a problem consistent with the landlord’s obligations under A.R.S. 33-1434 may wish to send the landlord a signed and dated letter (keeping a copy for the tenant’s own records) describing the problem in detail and requesting that the problem be fixed by the landlord as soon as reasonably possible.
