Question: under a civil judgement, as the appeal process is pending , do you have to pay the fine?
Answer: The filing of an appeal does not "stay" the judgement in either a civil case or civil traffic case. In order to stay the judgement the appealing party (the appellant) must post a "supersedeas bond in an amount equal to the judgement and costs." Rule 6(a)(1)of the Superior Court Rules of Appellate Procedure (Civil). Rule 26(c) of The Rules of Procedure for Civil Traffic Cases states "the posting of an appeal bond shall stay enforcement of the judgement." The Supreme Court has posted on its website a guide on "Representing Yourself: Appealing a Civil Case to the Superior Court".
