Question: I'm being sued for credit card debt of 1000.00. I answered the summons and now their attorneys want no trial but want the judge to resolve the issue. What are my options? Do they put a lien on my property?
Answer:
In most Arizona civil cases, you can demand a jury trial. Arizona Const. Art. 2, 23. In other words, despite the defense attorneys request for a “Bench Trial” (judge without jury), you have the right to a Jury Trial. If your case ends in a ”Judgment” against you, a lien can then be placed against your property for this debt, but not before you are formally held liable by in a court proceeding.
