  • Can the tenant give only a week's notice before moving out and can he take permanent fixtures such as cabinets if he paid for them?
  • My ex mostly has custody of our four-year-old boy. She quit her job the same week we went to court and then got hired back once child support was determined based on her not working and living with her cousin. Now, her green card has expired. She did receive a temporary extension to March 2015. She received her card through a fraud marriage and lied to immigration about her address, of course all this was found out through court. If she does not get her card renewed can she legally take our son to Mexico and continue to collect child support as she continually threatens to do?

My spouse now has a high income job offer out of state. We want to rent out our home instead of selling & dismiss the BK but still owe over $18k in arrears. With our bad credit due to the BK, what are our options for getting a loan to pay the arrears? Our home will rent for $2800 and our payment is 2k.

  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?
  • I had an unwritten deal with someone and he basically conned me out of $800. I sued him in Pima County small claims court. The court required that i name his spouse as a defendant as well. When the court date came, he had fled town and left his wife to deny everything in court for him. It turns out though he is not legally married to this woman, and that was made clear to the judge. Still, the judge dismissed my case with prejudice even though she was not his legal spouse and now i am out $800+. I even had a witness but he was late so unfortunately didn't get sworn in. What recourse do i have?
  • I am currently renting a home in Tucson that has a Swamp Cooler. The swamp cooler has not been keeping the house cool. The temperature reaches between 88-91 degrees inside even with many fans throughout house. The landlord has failed to offer any way of cooling down the house. If we want an AC unit in the windows we must pay for it. He has neglected to fix things because we pay "cheap rent for the neighborhood we're in." Is the landlord legally responsible for providing livable conditions such as accurate cooling?
