QUESTIONS

  • My lease ends 4/31/11. I moved out 3/15/11. I did fulfill my contract obligation of providing the lease check for 4/1/11. My (old) landlord cashed that check 4/4/11 I found out that he moved someone in 4/1/11. Is it legal for him to cash my 4/1/11 check and move someone in, REGARDLESS if I still occupy the dwelling and/or if he made them pay for April or not? I would think that by my yearly lease contract, he is not allowed to move anyone in until 5/1/11 since he accepted and cashed my 4/1/11 check.
  • Does the landlord have to provide proper and safe drinking water? Water and ice in refrigerator is hard and has flakes in the cup. Is this something that should be taken care of by landlord?
  • Our house has been with a broken AC for 3 weeks. We have had to wait for a repair, another repair, a second opinion, another attempted repair, etc. Today we were supposed to have someone come to our house and give us a new unit but when I asked my landlord where they were she said since our house was at 82 degrees we got pushed for people with hotter houses. Our house is cool because we had to rent a mobile AC unit. Our electric bill is twice as much due to a 30 year old AC. What right do we have and should our landlord pay for some of our electric bill?
  • Does the Late Fee Fairness Amendment Act Of 2016 also apply to mobile home park owners? I own my mobile but rent the lot. My landlord charged me a late fee on a late fee, but all of my rent has been paid on time. They claim that they can't apply my rent check for Dec. because it's not the full amount of my account, which includes the late fees. The late fee was because I was disputing the water bill and wasn't paying until we were able to speak about it on the phone, which was past the date that rent is due. They said they would waive the late fees, then reneged.
  • I recently purchsed a used boat and plan on suing the seller for breach of contract by material misrepresentation. He lives in Pinal County, I live in Maricopa County. The physical transaction occurred in Maricopa County, however the negotiations occurred over the internet. Can I file the claim in Maricopa County small claims court and have him served in Pinal County, or do I have to file in the county where he lives?
  • My ex-husband sent me a letter from prison, telling me he hired a lawyer to get a judge to ORDER me to take our 2 kids to see him. I have sole custody, and I had told him that i am not going to take them to a prison to visit him. When he was out, he never put any effort to see our kids, he only does this when he's in prison. Is is possible for him to get a court order to force me to take the kids to see him in prison?
