  • Hi! I am one of the very lucky people to be granted a new trial. There was an error at trial and the judge ordered a new trial. My question is what happens at a retrial? Is it the same testimony from the first trial or can the victims change their story? For example, the victim admitted hitting me first during the first trial. Can he change that or does testimony have to be the same? I need to know this to help make a decision regarding accepting a plea offer. My attorney is unsure.

  • In Sept. of 2014 my boyfriend pushed me down the stairs in our house and was arrested. Six months later Jan. 16, 2015 he punched me several times in the face breaking my nose and causing me to get 7 stitches above my left eye. He choked me and then forced me to sit in a chair while he threatened me. He fled before HPD arrived and was arrested in March for felony battery and coercion. I did not testify and charges were dropped. On Feb. 8th, 2017 he was arrested for DV. Can the prior charges get brought back in the new case even if he wasn't convicted?

  • My uncle passed away and owned an RV and other property that he paid lot fees inside an RV park. He has lived there for many years. The RV Manager and Owner are refusing to allow payments to keep the lot reserved while we get court papers to become executor of his estate. They intend to "evict" for non-payment if we have not removed the property by the end of the month. They will not let us access to his property without court papers. Can they refuse to accept payment from us and what are they legally required to do with his property?
