Question: My husband will still be in prison when our child is born, do I need to have him sign the birth certificate from prison or can I just list him as the father as we are married?
Answer: If you are married, he is presumed by the law to be the legal father. To be on the safe side, take a copy of your marriage certificate to the hospital with you. He does not need to sign an affidavit of paternity.
