QUESTIONS

  • We have had plumbing issues at our new apartment and have had maintenance in and out of the place however the toilet continues to overflow and the apartment manager has done nothing, they haven't even sent a plumber out yet and this has been happening for like 3 weeks now, do we have the right to hold our rent or put it on escrow or how would we be able to proceed? We have since had to use our clothing to stop the flooding from spreading any further in the apartment but it has flooded our hallway ,kitchen, and living room.
  • Can a pendente lite for child support be obtained if parents were never married and are awaiting a child custody trial?
  • can a spouse sign over guardianship which to someone when he never got it legale through a court of law or two doctors
  • I have a 6 month old child with a guy I used to date. We were never married. I want to know can I get full custody of our daughter. He is on the birth certificate and the notarized paternity papers. He is very unstable. He has abused me. He has been threatening me because I won't allow him to see her. I'm actually really scared. He keeps saying he wants nothing to do with her, she's not his, she can die. A bunch of hurtful things. The maybe a couple hours later he may say he's sorry and didn't mean it.But this has been ongoing for the month. He is always back and forth with his comments.
  • I am being evicted from my home and have court tomorrow, I wont be able to make it to court, and I understand that I will have a judgement placed against me. I have no reason to fight it because i am behind on rent. My question is, how soon after the judgement is made can money be taken from me. I am willing to pay the landlord and make payments but my husband is currently in the hospital recovering from a heart attack and the little bit of money i have in my account has to go towards medication.
  • I'm at the end of a two year lease. The landlord has a 20% rent increase if we don't do a new lease. Does he need to send us a written notice 30 days in advance that he intends to increase our rent 20% and the total amount that would make our new rent payment be? So far he has excepted the regular payment for two months passed the lease end date and now we just gave about a 50 day notice that we intend to move out.
  • I have an order for the parenting plan and the parents disagree about what the term "2 days before school starts" means. So if school starts on Monday when does the Child need to return back to the other parent? Sat? or Friday? Where can I find proof of this?
  • My boyfriend and I paid our rent 435 + 48 late fees for the prior month leaving us a balance of 65 dollars in late fees for this month. I seen AZ law states that a 10% total rent is the most that can be charged for late fees. Per the rental agreement, the only mention of late fees 25.00 + 5.00 daily late fees until for any portion of rent that is not paid. There is no section devoted to late fees as required by AZ law. I was wondering can a landlord charge late fees on the months late fees?
  • Under Phoenix fire code, what is my landlord required to provide in terms of fire prevention? Is a smoke detector required in every apartment?
  • Been divorced for 4 years now. We have 50/50 shared custody. My 14 year old daughter is refusing to go back to her dads as he mentally abuses her. I can not force her to go. Will I be in contempt of court if she doesn't not go back to her dads? She has been seeing her school counselor and she knows all the mental abuse she has been going through. She even cuts herself over it. Please help.
