Question: Can my ex husband take me back to court for custody or joint custody of our son if me and my boyfriend of a year move in together? i have sole custody right now and he has visitation...untill the child is two years of age then he gets him every other weekend
Answer: Either parent may request the court to modify a custody order. It must be shown that the best interests of the child are served in order to change an existing order. A request may not be filed for one year from the date of the earlier order, unless there are special circumstances seriously endangering a child’s physical, mental, emotional or moral health. ARS 25-411 – Modification of Custody Decree
