questions & answers

Question: i have a 2 yr. old daughter with my ex-boyfriend,we were never married but have legal joint custody together in az. i want to get a paternity test done but he refuses and i live in another state while they live in az. so my question is how can i get a paternity test done and what state does it need to be done in?

Answer:

You may want to look at the statues in the state where you reside. In Arizona, A.R.S. § 25-802 discusses venue requirements for maternity or paternity actions in Arizona. A.R.S. § 25-812 discusses the process for voluntary acknowledgment of paternity as well as actions to overcome paternity. You may want to generally review the Arizona laws in Article 25, Chapter 6, which discuss maternity and paternity proceedings.

Since your situation involves a family law issues in multiple states, you may want to contact an attorney for advice on how the laws apply to your specific situation. You can find resources to Arizona attorneys in the "Where to Find an Attorney for Specific Legal Advice" article on this website.
