Child Support
questions & answers
Question: How much time do I need to give when requesting modification of child support when one lives out of state
Answer: You have several methods for serving an ex who lives in another state. You can hire a process server to serve the documents or you can serve the documents by certified mail, return receipt requested. If you use a process server, he or she will complete a document called an "affidavit of service" that needs to be filed with the court. If you serve by certified mail, the return receipt is your evidence and you file it with your proof of service to the court. Once your ex has been served, he has 30 days to respond to your petition. (Rule 42j of Arizona Rules of Family Law Procedure.)
